Acceptance of the General Terms and Conditions of Sale
These General Terms and Conditions of Sale govern the contractual relations between any non-trading natural person wishing to make a purchase on the www.loesia.fr website. In this context, the buyer and the vendor agree that these General Terms and Conditions of Sale, together with the order, as agreed to by the company, the Conditions of Use of the Site and the Privacy Policy, exclusively govern their relations.
Amendment of the General Terms and Conditions of Sale
BBC under Loesia reserves the right to modify the General Terms and Conditions of Sale unilaterally and at any time. Changes to the General Terms and Conditions of Sale, once published online, will be applicable to all orders placed thereafter.
These General Terms and Conditions of Sale contain important information, in particular with regard to the guarantee and limits of liability. You hereby acknowledge that you have read and accepted them.
Definitions and Application
- In these General Terms and Conditions of Sale, “Loesia”. “You” refers to the buyer who places an order on this website and “Products” refers to Le Loesia products that can be ordered on the www.loesia.fr website.
- The purchase of a Product on this website implies the buyer’s unreserved acceptance of these terms and conditions of sale, which apply to any purchase delivered in a country in the European Union and in the world.
Geographical Area
The online sale of the Products presented on the website is reserved for buyers resident in the European Union, for deliveries requested in this geographical zone.
The Products
The products governed by these General Terms and Conditions are the products displayed on Loesia’s website accessible at www.loesia.fr. These products are offered for sale within the limits of available stocks.
Loesia shall do its utmost to ensure that photographic representations of the products are as accurate as possible. However, it is possible that your perception of the photographic representation of the Products on your own screen does not correspond exactly to the Product.
Prices and Payment
- The prices shown on this website are net sales prices (VAT not applicable, according to Article 293 B of the French General Tax Code). Prices may be modified at any time. However, it is understood that the price shown on the website on the day the order is confirmed shall be the only price applicable to the buyer.
- The total amount payable to Loesia for an order is the sum of the prices of all the products ordered as indicated on the website on the date of the order (Product Subtotal) and the delivery charges.
- Payment is required at the time of placing the order. Payments shall be made by credit card or PayPal, through the secure systems of PayPal and Stripe platform. The information transmitted is encrypted by software; no third party has access to it while it is being transmitted on the network.
- For certain countries in the European Union, you may be asked to pay applicable import taxes.
- Orders are placed on the WordPress platform via the “Shop” section of the www.loesia.fr website.
Liability
In the process of selling online, the vendor is only bound by an obligation of means and may not be held liable for any damage resulting from the use of the Internet network, such as data loss, hacking, viruses, interruption of service or other involuntary problems.
- If you do not pay for the order in accordance with these General Terms and Conditions of Sale, Loesia reserves the right to adopt the following measures:
a. to defer the delivery and place the Products ordered back in stock and/or
b. to have no further dealings with you, and Loesia will not be liable to you for any loss or damage resulting from such action.
- You are responsible for determining that the Products are suitable for your intended use.
- In accordance with the “Guarantee” clause below and within the limits defined by law, in the event that Loesia should fail in its obligations defined in the General Terms and Conditions of Sale or by other legal provisions (such failure including any defects inherent to the Product), Loesia’s liability shall be limited to the reimbursement or replacement of the Products in question.
Guarantee
The Products do not benefit from any commercial guarantee within the meaning of Articles L. 211-15 et seq. of the French Consumer Code.
The Products benefit from the legal guarantee provided for in Articles 1641 et seq. of the French Civil Code and in the provisions of articles L. 211-4 et seq. of the French Consumer Code.
In case of non-conformity of a product sold, within the meaning of these provisions, it may be returned free of charge to the vendor who will provide a replacement. Failing this, the provisions of Article L. 211-10 of the French Consumer Code shall be applied, under the terms of which:
“If neither repair nor replacement of the product is possible, the buyer may return the product and obtain reimbursement of the price or keep the product and obtain reimbursement of a portion of the price.
The buyer has the same option:
- If the solution requested, proposed or agreed pursuant to Article L. 211-9 cannot be implemented within one month of the buyer making their claim;
- Or if that solution cannot be implemented without major inconvenience for the buyer given the nature of the product and its intended use.
However, the sale shall not be cancelled if the lack of conformity is minor.”
Right of Withdrawal
In accordance with the provisions of Article L. 121-20 of the French Consumer Code, you have a right of withdrawal, which allows you to return the Products without giving a reason or incurring a penalty. However, if the return of the Products is due neither to a defect nor to an error on the part of Loesia, the cost of returning the goods shall be borne by you.
You may exercise this right within 7 clear days from receipt of the Products.
If you exercise this right of withdrawal, you shall, at your own expense, return the Products ordered, in a condition suitable for re-marketing, to the following address: CM 101 – Bât 22, 36 rue des Bellangères, 28630 Le Coudray, FRANCE.
Loesia shall issue a refund within 30 days from the date on which the right of withdrawal was exercised.
Refunds and Returns
Only items purchased on the Loesia website (www.loesia.fr) can be returned to Loesia for reimbursement or exchange. Items purchased from a department store, retailer or any other location must be returned to the original point of sale.
If you have made a mistake and purchased the wrong Product from us on our website, Loesia will exchange your Product for the Product you intended to purchase. The returned Product must not have been opened and must be in perfect condition for sale. The delivery and return costs shall be borne by you.
If the use of one of our Products has caused skin irritation, you can either exchange it or obtain a reimbursement.
The Products shall be returned to the company. The delivery costs of returning the Products shall be borne by the customer. In France, you will be invoiced for a delivery charge of EUR 6 (all taxes included).
If an item is damaged during transport between Loesia and the delivery location, it shall be exchanged or reimbursed by Loesia. The delivery costs for the return of the said Products shall be refunded if the Products sent do not conform to the order, if the Products are damaged during transport, or if they are defective.
In any event, an original proof of purchase must be provided and the Products must be returned within 14 days of receipt of the order in order for Loesia to proceed with any reimbursement or exchange. Please contact us by email at Bienvenue@loesia.fr before returning a product to us so that our sales staff can facilitate the process. We recommend that you keep the receipt obtained from the freight agent until you are assured that your package has been received by Loesia. We may ask you to produce it if we do not receive your package.
We shall endeavour to process your returns within 10 working days of receipt and the refund shall be made via the payment method you used for payment.
Force Majeure
In the event that Losia is delayed in executing or is unable to execute the obligations defined by the order owing to an unforeseeable event beyond its control, Loesia shall not be held responsible and the deadline for fulfilling the order shall be extended for the duration of the said event considered to be a case of force majeure.
Personal Data
The information submitted by you as part of your Product order will be subject to data processing. The website is hosted by the publisher WordPress.
Applicable Law
These General Terms and Conditions of Sale online are subject to French law and any dispute relating to their execution or interpretation shall fall under the jurisdiction of the Chartres courts, subject to applicable public policy provisions.

Delivery
The products are available for delivery to the address of your choice, as indicated during the ordering process, in mainland France, Corsica, Monaco or elsewhere in Europe. It is your responsibility to provide us with all details necessary to ensure the proper delivery of your order.
Depending on your order, we can offer you different delivery services. Your total share of the freight costs depends on the delivery method you choose and is reiterated during the delivery step of the online ordering process before its validation.
Your order will be treated within 2 working days from the validation of your order for orders, from Monday to Friday. Your order will be delivered no later than 10 working days after validation of your order, depending of the transporter.
Domestic Delivery
Delivery is free for all orders , including VAT (rates and conditions subject to change), in France.
Delivery in Europe
Delivery costs for home deliveries in Europe can be viewed by consulting the simulator available before validating the order. Additional charges may be required by the carrier before delivery of the package in accordance with the conditions of the importing country’s duties and taxes.
